Domestic Abuse and Harassment Injuctions
If you need to stop a person from harassing, threatening, injuring, or contacting you, you can request an injuction (Restraining Order) from the Court for up to two years. You can get an injuction yourself, or with the help of an attorney, or FAVR, phone 923-1700

Domestic Abuse Injuctions (Wis. Satute 813.12)
Domestic Abuse injuctions are used when you need protection from an adult family member, a spouse, a roommate, or a former roommate.

To get a Domestic Abuse Injuction, go to the Clerk of Courts office on the 2nd floor of the City-County Government Center, 160 S. Macy St, Fond du Lac, Wi., 929-3038. The Clerk's office has several papers you must fill out before you can appear in front of the Family Court Commissioner. There is also a charge that must be paid to the Clerk's office. If for some reason you can not pay the filing fee, the Clerk of Court's office has a form you can fill out that asks the Court to waive the fee. This form is called an "indigency" form.

Fill out all Court papers neatly and carefully. Include your name, the violator's name and address, and a short statement of facts telling what the person did to you and why you need the Court's help. You can also attach copies of police reports from any complaints that you have made.

Once you have filled out the papers, they must be filed with the Family Court Commissioner, also located on the 2nd floor of the City-County Gov't Center, phone 929-3075. The Family Court Commissioner reviews the papers immediately and issues a Tempory Restraining Order (TRO) if reasonable grounds exist to believe the respondent has engaged or will in engage in Domestic Abuse of the petitioner.

A TRO is granted, the Family Court Commsisioner sets a hearing within 14 days to decide if an injuction should be granted. It is your responsibility to have the respondent "served" with papers. The Fond du Lac County Sheriff's Department will serve the papers for a small fee, phone 929-3375.

At the injuction hearing, both the petitioner and respondent may give evidence to the Family Court Commissioner. The Family Court Commissioner may then grant an injuction for up to two years.

It is a crime to violate a Domestic Abuse Injuction. Contact the police immediately to report it. You will need to show the Order to the police. A violator can be arrested and face up to a $1,000 fine and 9 months in jail.

Harassment Injuctions (Wis. Satute 813.125)
Harassment Injuctions are used against anyone who strikes, shoves, kicks, or otherwise subjects a person to physical contact or attempts or threatens to do so. They are also used against anyone who repeatedly commits acts which harass or intimidate another person and which serve no legitimate purpose.
